1. Shipping Coverage
Gemstix currently ships within the continental United States to locations where tobacco delivery is legally permitted. We do not ship internationally or to P.O. Boxes, APO/FPO addresses, or U.S. territories. Shipping laws change frequently, and we reserve the right to update our service areas at any time to maintain compliance.
2. Shipping Costs
Because Gemstix is a small business, we aim to keep shipping simple and sustainable. Most subscription boxes include standard ground shipping within the continental U.S. For non-subscription or bulk orders, shipping fees may apply based on weight, location, and carrier costs. Any shipping fees will be clearly displayed at checkout.
We may occasionally offer free or discounted shipping promotions at our discretion.
3. Delivery Requirements and Restrictions
3.1 Adult Signature Requirements
Depending on state and local laws, an adult signature (21+) and government-issued photo ID may be required upon delivery. It is the recipient's responsibility to ensure compliance with any applicable age verification or delivery restrictions at the delivery address. Carriers may refuse to leave packages unattended if such regulations apply.
3.2 Restricted States and Jurisdictions
Due to varying state tobacco regulations, Gemstix cannot ship tobacco products to certain states. We maintain a list of restricted states where direct-to-consumer tobacco shipments are prohibited or restricted by state law. These restrictions are in place to ensure compliance with all applicable regulations.
Currently, we cannot ship to the following states: Utah, New York, Connecticut, Maryland, Arkansas, Hawaii, Ohio, Oregon, Vermont, South Dakota, Washington, and California.
This list may change at any time to comply with evolving state and local regulations. We will verify your shipping location during checkout, and orders to restricted states will not be processed. 3.3 Carrier Limitations
We use major carriers such as UPS, FedEx, or USPS based on your delivery address and the nature of your order. The specific carrier may vary per shipment.
4. Processing and Delivery Times
4.1 Order Processing
Orders typically ship within 7–10 business days after payment is processed. Subscription shipments follow the recurring schedule established during enrollment.
4.2 Transit Times
Once shipped, delivery generally takes 3–7 business days, depending on your location and carrier performance. Rural or remote areas may experience longer transit times.
4.3 Delays
We may delay shipments during extreme weather conditions or holidays to protect product quality or ensure successful delivery.
5. Packaging and Handling
We take care to pack cigars in protective, humidity-controlled materials to help maintain freshness during transit. However, Gemstix cannot guarantee perfect climate control after a package leaves our facility.
All shipments are sent in plain, unmarked packaging for your privacy.
6. Missed Deliveries and Unclaimed Packages
If no one 21+ is available to sign for a package, carriers will generally attempt redelivery or provide pickup instructions. If the package is returned to us as unclaimed, you may request reshipment by paying the associated reshipping costs. Refunds are not available for unclaimed or refused packages.
7. Lost, Stolen, or Damaged Shipments
7.1 Lost or Stolen Packages
If your package is marked as delivered by the carrier but cannot be located, please first check with neighbors or household members. If the package remains missing, contact the carrier to initiate a claim and notify us via our contact form at gemstix.com/contact within 7 days. Gemstix is not responsible for packages confirmed as delivered but will work with you on a case-by-case basis.
7.2 Damaged Shipments
If your order arrives damaged, please take photos of the package and cigars within 24 hours of delivery and contact us via our contact form. We may offer replacements or store credit at our discretion.
8. Address Changes
You may update your shipping address at any time using your online account or by contacting us. Please make changes at least 5 business days before your next scheduled shipment to ensure proper delivery. Once an order ships, address changes cannot be applied.
9. Holidays and Weather Delays
Shipping may be delayed during major holidays, severe weather events, or carrier capacity issues. While we make every effort to communicate known delays, Gemstix is not responsible for circumstances outside our control.
10. International Shipping
Gemstix currently ships only within the continental United States. We do not offer international shipping due to regulatory restrictions.
